The Nevada Resort Association intervenes in betting legal battle

In the ongoing legal battle between KalshiEx LLC (Kalshi) and Nevada gaming regulators, the Nevada Resort Association has intervened to add to the rising tensions.

The case centres around the Nevada Gaming Control Board’s (NGCB) decision to place a cease-and-desist order on Kalshi after the regulator found the predictions provider was in breach of operational rules.

Nevada Resort Association wades into Kalshi dispute

As we reported, Kalshi secured a vital victory in the battle between the company and state regulators to continue operations early in April (2025). Kalshi was granted favour in the decision made by US District Court Judge Anthony Gordon, but this was a temporary measure whilst the case rumbles on.

Judge Gordon stated that, “Kalshi has shown a likelihood of success on the merits. Conversely, the defendants have not shown a likelihood of success on their countermotion for injunctive relief, so I deny their motion.”

This hasn’t gone down well with the complaining parties since the predictions company is believed to require the correct legislative documentation and adhere to the preexisting rules to operate within the Silver State’s lines.

The fear for Nevada regulators is that if similar companies are given the freedom to operate without the correct terminology and licensing, then the $7.8 billion in annual state profits and taxable coffers could be at serious risk.

The Nevada Resort Association has been given the green light to intervene to give their perspective on the Kalshi case. The regulator argues that Kalshi is being given an “unfair advantage” over competitors and also existing licensed operators in the state that offer identical sports wagering opportunities.

If Judge Gordon is to rule in favour of Kalshi, the Nevada Resort Association is adamant that the licensing and operational responsibility within the state would be called into conflict.

Nevada isn’t the only state that has well-established frustrations with Kalshi, as New Jersey regulators have filed the same legal challenge against the company. The State of Maryland also saw Kalshi submit a similar injunction when the pressure was put on the company by the state’s gambling authorities.
